Fresh Evidence Unveiled as Prosecutors Rebuild Final Months
The high-profile trial of Jamie Varley and John McGowan-Fazakerley has entered a pivotal stage at Preston Crown Court, with prosecutors presenting compelling new evidence to reconstruct the harrowing final months of 13-month-old Preston Davey’s life. The case, which has gripped the nation, centres on allegations of systematic physical and sexual abuse suffered by the toddler in the care of his adoptive parents.
Preston Davey, described by those who knew him as a sweet, bubbly, and smiley baby, was adopted by Varley, a 37-year-old former high school teacher and head of year, and his partner John McGowan-Fazakerley, 32, a financial sales manager, in April 2023. Just four months later, on 27 July 2023, Preston was rushed to Blackpool Victoria Hospital in cardiac and respiratory arrest. He was pronounced dead despite extensive resuscitation efforts.
Medical experts have provided devastating testimony detailing over 40 external and internal injuries consistent with repeated abuse. These included bruises to the head, face, arms, legs, chest, back, and buttocks, as well as internal trauma to the throat, mouth, bladder, bowel, and evidence of forcible penetration. Pathologists ruled out drowning — Varley’s initial claim that he briefly left Preston in the bath and returned to find him submerged — noting the child’s hair was dry and there was no water in his lungs. The cause of death was determined to be acute upper airway obstruction, likely from smothering or insertion of an object.
Prosecutors have highlighted disturbing video evidence and phone records. One video recovered from Varley’s phone showed Preston in extreme respiratory distress four days before his death. Phone data and medical visits revealed a pattern of “cluster” injuries emerging shortly after Preston moved into the couple’s Blackpool home. The court heard how Preston had been taken to hospital multiple times in the preceding weeks with unexplained bruising, seizures, and breathing difficulties, yet concerns were not escalated sufficiently at the time.
In police interviews played to the jury, McGowan-Fazakerley struggled to account for the injuries, insisting he never harmed the child and had misplaced trust in his partner. Varley denied all allegations, maintaining the death was accidental. Both men face multiple charges including murder, manslaughter, child cruelty, sexual assault, and the making and distribution of indecent images of a child. They deny all counts.
